第一篇 交易磋商与合同的拟定
一、外贸交易与磋商

在此过程中，交易双方应进行市场调查，以确定交易商品的合理价格，并且各自做出进口预算、出口预算，以预算本次交易的利润，决定是否进行交易。
二、外贸合同的拟定

交易双方就此前的交易磋商中设定好的相关细节，由出口商（史悦悦）按如下格式列入合同中，并交由进口商（王莉）进行再审核，确认相关细节无误后，双方签订合同。
1）约首 包括：⑴合同名称⑵编号⑶订约日期和订约地点⑷各方当事人的名称和地址⑸电报挂号⑹电传号码⑺传真号码⑻买卖双方订立合同的意愿⑼执行合同的保证。
2）正文
包括：⑴商品名称：商品全称（实习中可虚拟） ⑵品质规格：需将商品所有规格和比例列出 ⑶数量：数量必须注明计量单位 ⑷包装：包装计量单位及物料名称必须同数量的计量单位及规格中的包装物料名称相一致
⑸单价：合理运用价格术语
⑹总值：需同单价、计价货币相一致 ⑺装运期限 ⑻装运港 ⑼目的港
⑽保险：注意按CIF贸易术语成交时与FOB、CFR成交时的规定不同 ⑾付款条件：采用信用证支付方式，必须详列信用证性质 ⑿单据：详列卖方交单议付的各项单据 ⒀装船通知：注意FOB、CFR术语
⒁商品检验：列明检验机构、检验方式、检验证书、检验时间和地点 ⒂不可抗力
⒃索赔：明确索赔方式、期限
