摘要
普通高校的校纪校规作为一种自治规范，是普通高校进行自主管理的重要依据，并具有显著的法律特征，它对依法治校、落实高校办学自主权以及构建现代大学制度具有重大的意义。普通高校制定校纪校规之初衷，是为了更好的教育育人，但目的之正当并不必然保证手段的合法，校纪校规的制定如果越界，就会侵犯学生的合法权益。近年来，我国普通高校校纪校规的建设取得了一些成绩，但是由于理论研究的滞后以及校纪校规制定本身存在的不足，当前我国普通高校校纪校规在合法性方面存在一些问题。本文研究我国普通高校校纪校规在合法性方面存在的不足，希望能为我国普通高校制定合法有效的校纪校规提供一定的指导。
论文共有四个部分。第一部分“绪论”。主要介绍选题的背景，研究的目的、意义、研究综述、研究方法以及研究思路。第二部分“普通高校校纪校规法律性质分析”。主要研究普通高校的法律地位与法律性质存在的矛盾，最后对普通高校校纪校规的法律性质给与界定。第三部分“普通高校校纪校规法律效力分析”。区分一般事项的法律效力与重大事项的法律效力，以及校纪校规在司法使用中的地位。第四部分“重塑校纪校规合法性的若干思考”。首先提出重塑校纪校规合法性应当遵循的原则，如实体上的法律平等原则、正当程序原则以及比例原则等，然后再对重塑校纪校规合法性提出具体构想。

Abstract

school-runningautonomyandconstructingthemodernuniversitysystemisofgreatsignificance.Theordinaryuniversityschoolrulesenactedwithdrawingtheoriginalpurposeistobettereducation,butthepurposeisnotnecessarilytheguaranteejustmeansoflegal,withdrawingtherulesenactedifwillinfringeuponstudentsacrossthelegitimaterightsandinterests.Inrecentyears,notinordinarycollegeswithdrawingtheconstructionmadesomeachievements,butbecauseofthelagoffundamentalresearchandwithdrawingthedefectsoftheschoolrulessetitself,thecurrentaveragecollegewithdrawinginlegitimacywithdrawingsomeproblems.Thispaperstudiestherulesinordinarycollegeswithdrawingthedefectsofthelegitimacyinordinarycolleges,thehopecansetlegaleffectivewithdrawingprovidecertainrulesguidance.
Paperconsistsoffourparts.Thefirstpart\Mainlyintroducesthebackground,researchtopicoftheaim,significance,researchreview,researchmethodsandresearch.Thesecondpartof%universitylawschoolpropertyanalysis\.Themainresearchordinaryuniversitylegalstatusandlegalnature,finallythecontradictionsinordinaryuniversitieswithdrawingthelegalnatureofwithdrawingtodefine.Thethirdpartofthe\collegewithdrawingruleslegaleffectanalysis\Distinguishbetweenthelegaleffectofgeneralmatterswithmajormattersofthelegaleffectiveness,andwithdrawingthepositioninjudicialuseschoolrules.Thefourthpart\withdrawingthelegitimacyofsomethinking\schoolrules.Firstproposedtoreshapewithdrawingshallfollowtheprincipleoflegalityrules,suchasphysicallegalequalityprinciple,theprincipleofdueprocessandproportionprincipleandsoon,andthenputforwardtoreshapewithdrawingspecificidea.Withdrawinglegitimacy
